BioTRK Terms of Service

1. Foundational Eligibility and Access

The Ecosystem is engineered exclusively for adult populations. By accessing the platform, you represent and warrant that you are at least eighteen (18) years of age, or the applicable age of legal majority in your jurisdiction of residence, and possess the legal authority to enter into this binding agreement. You are solely responsible for maintaining the confidentiality of your authentication credentials and for all activity executed under your account.

2. Strict Limitation of Scope: Non-Medical Education & Telehealth Classification

BioTRK operates strictly as an advanced technological aggregator and health optimization engine. We are not a licensed medical clinic, healthcare provider, diagnostic laboratory, or health insurance underwriter. The platform does not engage in the practice of medicine, does not provide clinical services, and does not establish a physician-patient relationship.

The Ecosystem is explicitly contraindicated for use in emergency scenarios; in the event of acute physiological distress or a life-threatening crisis, you must immediately contact local emergency services (e.g., 911) or proceed to the nearest emergency medical facility.

To ensure absolute compliance with the Republic of Singapore’s Health Sciences Authority (HSA) regulations regarding standalone mobile applications and telehealth devices, the following statutory clarification applies to all platform usage: This device or software is intended for use only for general well-being purposes or to encourage or maintain a healthy lifestyle, and is not intended to be used for any medical purpose (such as the detection, diagnosis, monitoring, management or treatment of any medical condition or disease). Any health-related information provided by this device or software should not be treated as medical advice. Please consult a physician for any medical advice required.

3. Third-Party Diagnostic Integrations & Inherent Biological Risks

The paid tiers of the Ecosystem may facilitate advanced physiological testing through independent, third-party clinical laboratories. By utilizing these integrations, you explicitly acknowledge and assume the following risks:

• Inherent Physical Risks: The extraction of biological samples (such as blood draws or phlebotomy) carries inherent, albeit minor, physiological risks, including but not limited to localized bruising, hematoma, or infection.
• Regulatory Status of Diagnostics: Certain advanced biomarker assessments may include Laboratory Developed Tests (LDTs) that have not undergone formal pre-market clearance or approval by regulatory bodies such as the US Food and Drug Administration (FDA) or the Singapore HSA.
• Protocol Adherence: You bear sole responsibility for strictly adhering to all collection, stabilization, and shipping protocols provided with biological kits. BioTRK is not liable for sample rejection resulting from improper handling or insufficient quantity, and you will bear the financial responsibility for such outcomes.
• Critical Alerts: While independent laboratories may attempt to communicate critically abnormal out-of-range results, neither BioTRK nor the third-party providers are under a legally binding obligation to ensure you receive or act upon these alerts.

4. Algorithmic Intelligence & Output Limitations

BioTRK heavily integrates sophisticated artificial intelligence and generative conversational models to synthesize health data. You must recognize that outputs generated by AI-assisted tools are inherently probabilistic and may occasionally contain inaccuracies, incomplete contextualization, or flawed extrapolations. These algorithmic outputs are strictly for educational exploration and must never substitute for localized clinical judgment or be relied upon for time-sensitive medical decisions.

5. Acceptable Utilization & Intellectual Property Sovereignty

BioTRK grants you a highly restricted, revocable, non-exclusive, and non-transferable license to utilize the Ecosystem strictly for personal, non-commercial health optimization. All underlying software architecture, visual designs, and proprietary algorithms remain the exclusive intellectual property of BioTRK and its licensors.

Your license is predicated on strict adherence to our Acceptable Use parameters. You explicitly agree not to:

• Deploy automated extraction tools, web scrapers, or heuristic algorithms to harvest data.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Use the Ecosystem for any unlawful purpose or to transmit malicious code or viruses.
• Utilize the platform’s analytical outputs to benchmark performance for the development of a competing digital health product.

If you believe any content on the platform infringes upon your copyright, you may submit a formal notification pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent at hello@biotrk.io.

6. Financial Provisions & Service Access

The BioTRK economic model relies on subscription fees and laboratory integration costs. All fees are strictly non-refundable. The sole exceptions to this policy are:

• A cancellation request executed within a strictly defined 48-hour window following the initial transaction, provided that no clinical services have been delivered and no biological sample kits have been dispatched.
• The issuance of platform credits in instances where a specific biomarker test is formally declined by an affiliated clinical reviewer due to physiological contraindications.

7. Disclaimers, Warranty Exclusions, and Risk Allocation

The digital architecture, longevity content, and all integrated third-party laboratory data are provided strictly on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by global jurisprudence, BioTRK expressly disclaims all warranties, whether statutory, express, or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. BioTRK does not control or guarantee the quality, appropriateness, or clinical outcome of any services provided by independent Third-Party Providers or laboratories. BioTRK shall not be held liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the platform.

8. Jurisdictional Dispute Resolution & Arbitration Mandate

To ensure rapid and cost-effective resolution, any controversy, claim, or dispute arising out of or relating to these Terms shall be settled by binding, individual arbitration.

• Class Action Waiver: You expressly and unconditionally waive the constitutional right to a trial by jury and the right to participate in any form of class action lawsuit, class-wide arbitration, or consolidated legal proceeding.
• Exclusive Arbitration Venue: As a Singapore-based entity, any dispute arising from a cross-border or domestic contract shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC). The seat (legal home) of the arbitration shall be Singapore. Arbitral awards issued in Singapore are enforceable globally in over 170 countries under the New York Convention.
• Temporal Limitation: Any legal claim or cause of action arising from the utilization of the platform must be officially filed within two (2) years after the initial cause of action accrues; failure to meet this strict deadline will result in the permanent legal barring of the claim.

11. Affiliate Disclosures

BioTRK.io is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. When you click on product links within the platform and make a purchase, BioTRK may receive a small commission at no additional cost to you.

All product recommendations on BioTRK are generated based on your health data, biomarker results, and clinical evidence. Commission rates never influence which products are recommended. Our AI assessment system operates independently of any commercial relationship.
